We host the content of our website with the following provider:

External hosting

This website is hosted externally. The personal data collected on this website is stored on the servers of the host(s). External hosting is carried out for the purpose of fulfilling contracts with our prospective and existing customers (Art. 6(1)(b) GDPR) and in the interest of secure, fast, and efficient provision of our online offering by a professional provider (Art. 6(1)(f) GDPR). If corresponding consent has been requested, processing takes place exclusively on the basis of Art. 6(1)(a) GDPR and § 25(1) TDDDG, insofar as the consent includes the storage of cookies or access to information on the user’s terminal device (e.g., device fingerprinting) within the meaning of the TDDDG. Consent can be revoked at any time.

Our host(s) will process your data only to the extent necessary to fulfil its performance obligations and will follow our instructions with regard to this data. We use the following host: netcup GmbH, Daimlerstraße 25, D-76185 Karlsruhe, Germany.

The controller responsible for data processing on this website is:

Ceperia GmbH
Speditionstr. 15a
40221 Düsseldorf
Germany

Email: info@onecivic.now

Storage period

Unless a more specific storage period has been specified within this privacy policy, your personal data will remain with us until the purpose for the data processing no longer applies. If you assert a legitimate request for deletion or revoke your consent to data processing, your data will be deleted unless we have other legally permissible reasons for storing your personal data (e.g., retention periods under tax or commercial law); in the latter case, deletion will take place after these reasons cease to apply.

General information on the legal basis for data processing on this website

If you have consented to data processing, we process your personal data on the basis of Art. 6(1)(a) GDPR or Art. 9(2)(a) GDPR if special categories of personal data are processed under Art. 9(1) GDPR. In the case of explicit consent to the transfer of personal data to third countries, data processing is also based on Art. 49(1)(a) GDPR. If you have consented to the storage of cookies or access to information on your terminal device (e.g., via device fingerprinting), data processing is additionally based on § 25(1) TDDDG. Consent can be revoked at any time.

If your data is required for the performance of a contract or for the implementation of pre-contractual measures, we process your data on the basis of Art. 6(1)(b) GDPR. Furthermore, if your data is required to fulfil a legal obligation, we process it on the basis of Art. 6(1)(c) GDPR. Data processing may also be carried out on the basis of our legitimate interest under Art. 6(1)(f) GDPR. The relevant legal bases in each individual case are explained in the following sections of this privacy policy.

Transfers to third countries and to US companies not certified under the DPF

We use, among other things, tools from companies based in third countries that are not considered to have an adequate level of data protection, as well as US tools whose providers are not certified under the EU–US Data Privacy Framework (DPF). If these tools are active, your personal data may be transferred to these countries and processed there. We note that no level of data protection comparable to that of the EU can be guaranteed in such third countries.

We note that the USA is generally considered a safe third country with a level of data protection comparable to the EU. Data transfer to the USA is permissible if the recipient is certified under the “EU–US Data Privacy Framework” (DPF) or has appropriate additional safeguards. Information on transfers to third countries, including the data recipients, can be found in this privacy policy.

Recipients of personal data

In the course of our business activities, we work with various external bodies. In some cases, it is also necessary to transfer personal data to these external bodies. We only disclose personal data to external bodies if this is necessary in the context of contract fulfilment, if we are legally obliged to do so (e.g., disclosure of data to tax authorities), if we have a legitimate interest in the disclosure pursuant to Art. 6(1)(f) GDPR, or if another legal basis permits the disclosure. When using processors, we disclose personal data of our customers only on the basis of a valid data processing agreement. In the case of joint processing, a joint processing agreement is concluded.

Revocation of your consent to data processing

Many data processing operations are only possible with your express consent. You can revoke consent you have already given at any time. The lawfulness of the data processing carried out up to the revocation remains unaffected by the revocation.

Right to object to data collection in special cases and to direct advertising (Art. 21 GDPR)

If data processing is based on Art. 6(1)(e) or (f) GDPR, you have the right at any time to object to the processing of your personal data for reasons arising from your particular situation; this also applies to profiling based on these provisions. The respective legal basis on which processing is based can be found in this privacy policy. If you object, we will no longer process your affected personal data unless we can demonstrate compelling legitimate grounds for processing that override your interests, rights and freedoms, or the processing serves the establishment, exercise or defence of legal claims (objection under Art. 21(1) GDPR).

If your personal data is processed for direct marketing purposes, you have the right to object at any time to the processing of personal data concerning you for such marketing; this also applies to profiling insofar as it is related to such direct marketing. If you object, your personal data will subsequently no longer be used for direct marketing purposes (objection under Art. 21(2) GDPR).

Right to lodge a complaint with the competent supervisory authority

In the event of infringements of the GDPR, data subjects have the right to lodge a complaint with a supervisory authority, in particular in the Member State of their habitual residence, place of work or place of the alleged infringement. The right to lodge a complaint exists without prejudice to other administrative or judicial remedies.

Right to data portability

You have the right to receive data that we process automatically on the basis of your consent or in fulfilment of a contract, in a commonly used, machine-readable format, and to have it transmitted to you or to a third party. If you request the direct transfer of the data to another controller, this will only take place insofar as it is technically feasible.

Information, correction and deletion

Within the framework of the applicable legal provisions, you have the right at any time to obtain information free of charge about your stored personal data, its origin and recipients, and the purpose of the data processing and, if applicable, a right to correction or deletion of this data. For this and other questions about personal data, you can contact us at any time.

Right to restriction of processing

You have the right to request restriction of the processing of your personal data. You can contact us at any time for this purpose. The right to restriction of processing exists in the following cases:

  • If you dispute the accuracy of your personal data stored by us, we usually need time to verify this. For the duration of the verification, you have the right to request restriction of the processing of your personal data.
  • If the processing of your personal data was/is unlawful, you can request the restriction of data processing instead of deletion.
  • If we no longer need your personal data, but you need it to exercise, defend or assert legal claims, you have the right to request restriction of the processing of your personal data instead of deletion.
  • If you have lodged an objection pursuant to Art. 21(1) GDPR, a balance must be struck between your interests and ours. As long as it has not yet been determined whose interests prevail, you have the right to request restriction of the processing of your personal data.

If you have restricted the processing of your personal data, this data may – apart from being stored – only be processed with your consent or for the establishment, exercise or defence of legal claims or to protect the rights of another natural or legal person or for reasons of important public interest of the European Union or a Member State.

SSL/TLS encryption

This site uses SSL/TLS encryption for security reasons and to protect the transmission of confidential content, such as orders or enquiries that you send to us as the site operator. You can recognise an encrypted connection by the fact that the address line of the browser changes from “http://” to “https://” and by the lock symbol in your browser line.

If SSL/TLS encryption is activated, the data you transmit to us cannot be read by third parties.

Objection to promotional emails

The use of contact data published within the scope of the imprint obligation for the sending of unsolicited advertising and information material is hereby objected to. The operators of the pages expressly reserve the right to take legal action in the event of the unsolicited sending of advertising information, such as spam emails.

4. Data collection on this website

Cookies

Our website uses so-called “cookies”. Cookies are small data packages and do not cause any damage to your device. They are either stored temporarily for the duration of a session (session cookies) or permanently (permanent cookies) on your device. Session cookies are automatically deleted at the end of your visit. Permanent cookies remain stored on your device until you delete them yourself or automatic deletion occurs via your web browser.

Cookies may originate from us (first-party cookies) or from third-party companies (so-called third-party cookies). Third-party cookies enable the integration of certain services from third-party companies within websites (e.g., cookies for processing payment services).

Cookies have various functions. Many cookies are technically necessary, as certain website functions would not work without them (e.g., shopping cart function or video display). Other cookies can be used to evaluate user behaviour or for advertising purposes.

Cookies that are required to carry out the electronic communication process, to provide certain functions you request (e.g., for the shopping cart function) or to optimise the website (e.g., cookies for measuring the web audience) are stored on the basis of Art. 6(1)(f) GDPR unless another legal basis is specified. The website operator has a legitimate interest in storing necessary cookies for the technically error-free and optimised provision of its services. If consent to the storage of cookies and comparable recognition technologies has been requested, processing takes place exclusively on the basis of this consent (Art. 6(1)(a) GDPR and § 25(1) TDDDG); consent can be revoked at any time.

You can configure your browser so that you are informed about the setting of cookies and allow cookies only in individual cases, exclude the acceptance of cookies for certain cases or in general, and activate the automatic deletion of cookies when closing the browser. If cookies are deactivated, the functionality of this website may be limited.

Server log files

The provider of the pages automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. These are:

  • Browser type and browser version
  • Operating system used
  • Referrer URL
  • Host name of the accessing computer
  • Time of the server request
  • IP address

This data is not merged with other data sources. This data is collected on the basis of Art. 6(1)(f) GDPR. The website operator has a legitimate interest in the technically error-free presentation and optimisation of its website – for this, server log files must be collected.

Cookiebot also stores a cookie in your browser in order to be able to assign the consents you have given or their revocation to you. The data collected in this way is stored until you ask us to delete it, delete the Cookiebot cookie yourself, or the purpose for storing the data no longer applies. Mandatory statutory retention obligations remain unaffected.

Cookiebot is used to obtain the legally required consents for the use of certain technologies. The legal basis for this is Art. 6(1)(c) GDPR.

Data processing agreement

We have concluded a data processing agreement (DPA) with the above provider. This is a contract required under data protection law which ensures that the provider processes the personal data of our website visitors only in accordance with our instructions and in compliance with the GDPR.

Contact form

If you send us enquiries via the contact form, your details from the enquiry form, including the contact data you provide there, will be stored by us for the purpose of processing the enquiry and in case of follow-up questions. We do not pass this data on without your consent.

This data is processed on the basis of Art. 6(1)(b) GDPR if your enquiry is related to the fulfilment of a contract or is necessary to carry out pre-contractual measures. In all other cases, processing is based on our legitimate interest in the effective processing of enquiries addressed to us (Art. 6(1)(f) GDPR) or on your consent (Art. 6(1)(a) GDPR) if it has been requested; consent can be revoked at any time.

The data you enter in the contact form will remain with us until you request deletion, revoke your consent to storage, or the purpose for storing the data no longer applies (e.g., after your enquiry has been processed). Mandatory legal provisions – in particular retention periods – remain unaffected.

Enquiries by email

If you contact us by email, your enquiry including all resulting personal data (name, enquiry) will be stored and processed by us for the purpose of handling your request. We do not pass this data on without your consent.

Mandatory legal provisions – in particular legal retention periods – remain unaffected.

5. Analytics tools, advertising and plugins

Google Tag Manager

We use Google Tag Manager. The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland.

Google Tag Manager is a tool that helps us integrate tracking or statistics tools and other technologies on our website. Google Tag Manager itself does not create user profiles, store cookies, or conduct independent analyses. It only serves to manage and deploy the tools integrated via it. However, Google Tag Manager does collect your IP address, which may also be transmitted to Google’s parent company in the United States.

The use of Google Tag Manager is based on Art. 6(1)(f) GDPR. The website operator has a legitimate interest in the quick and uncomplicated integration and management of various tools on its website. If corresponding consent has been requested, processing takes place exclusively on the basis of Art. 6(1)(a) GDPR; consent can be revoked at any time.

Google Analytics

This website uses functions of the web analytics service Google Analytics. The provider is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

Google Analytics enables the website operator to analyse the behaviour of website visitors. In doing so, the website operator receives various usage data, such as page views, dwell time, operating systems used and the user’s origin. This data may be summarised by Google in a profile that is assigned to the respective user or their device.

We may also use Google Analytics to record your mouse movements and scroll behaviour and clicks. Furthermore, Google Analytics uses various modelling approaches to supplement the recorded data sets and uses machine learning technologies in data analysis.

Google Analytics uses technologies that enable the recognition of the user for the purpose of analysing user behaviour (e.g., cookies or device fingerprinting). The information collected by Google about the use of this website is usually transmitted to a Google server in the USA and stored there.

The use of this analytics tool is based on Art. 6(1)(f) GDPR. The website operator has a legitimate interest in analysing user behaviour in order to optimise both its web offering and its advertising. If corresponding consent has been requested (e.g., consent to store cookies), processing takes place exclusively on the basis of Art. 6(1)(a) GDPR; consent can be revoked at any time.

Data transfer to the USA is based on the Standard Contractual Clauses of the European Commission. Details can be found here: privacy.google.com/businesses/controllerterms/mccs.

IP anonymisation

We have activated the IP anonymisation function on this website. As a result, your IP address will be shortened by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area before being transmitted to the USA. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. On behalf of the operator of this website, Google will use this information to evaluate your use of the website, to compile reports on website activity, and to provide other services related to website usage and internet usage to the website operator. The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data.

Browser plugin

You can prevent the collection and processing of your data by Google by downloading and installing the browser plugin available at the following link: tools.google.com/dlpage/gaoptout.
